Hardship License NY

If you are arrested for DWI in Buffalo NY for having a BAC of .08 or more your drivers license will be suspended pending prosecution. If you can prove to the Court that the suspension will cause an "extreme hardship", the Court will grant you a Hardship Privilege, and issue you a Hardship License.

The definition of extreme hardship is the inability to obtain alternative means of travel to or from the licensee's employment, or to or from necessary medical treatment for the licensee or a member of the licensee's household, or if the licensee is a matriculating student enrolled in an accredited school, college or university travel to or from such licensee's school, college or university if such travel is necessary for the completion of the educational degree or certificate. A finding of extreme hardship may not be based solely upon the testimony of the licensee.

If granted, the hardship privilege will permit the operation of a vehicle only for travel to or from the licensee's employment, or to or from necessary medical treatment for the licensee or a member of the licensee's household, or if the licensee is a matriculating student enrolled in an accredited school, college or university travel to or from such licensee's school, college or university if such travel is necessary for the completion of the educational degree or certificate. If the Court finds against the driver, the driver may receive a Conditional License pending prosecution after 30 days, if eligible.
